01Acceptance of Terms
By accessing or using IncorpSarthi's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our platform. We reserve the right to modify these terms at any time with reasonable notice to users. Continued use after modifications constitutes acceptance.
02Services Offered
IncorpSarthi is a professional services facilitating platform that connects users with qualified CA/CS professionals. We assist with company registration, GST, trademark, and compliance filings. We are a facilitation platform, not a law firm, and do not provide direct legal advice. All legal and professional work is performed by our empanelled experts.
03User Eligibility & Registration
You must be at least 18 years old and legally capable of entering into binding contracts to use our services. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account. Please notify us immediately of any unauthorized use.
04User Responsibilities
Users must provide accurate, complete, and up-to-date information. You are solely responsible for the accuracy of documents you upload and information you provide. Providing false or misleading information may result in service cancellation without refund and may expose you to legal liability under applicable Indian laws.
05Payment & Refund Policy
Service fees are payable in advance before work commences. Refunds are available within 24 hours of payment if work has not started. Once filings or applications are initiated with government portals, partial refunds may be offered at our discretion. Government fees, stamp duties, and filing charges paid are strictly non-refundable.
06Timeline & Delivery
Estimated timelines mentioned on our platform are indicative and based on standard government processing times. We are not liable for delays caused by government portal downtimes, processing backlogs, incomplete documents provided by you, or any other factors beyond our reasonable control.
07Confidentiality
We maintain strict confidentiality of all client information, documents, and business details. Our CA/CS professionals are bound by professional ethics codes and confidentiality obligations. We will not disclose your information to any third party except as required for service delivery or by law.
08Intellectual Property
All content, trademarks, logos, and intellectual property on the IncorpSarthi platform belong to us or our licensors. Users may not reproduce, distribute, modify, or use our content for any commercial purpose without our express written permission.
09Limitation of Liability
IncorpSarthi's total liability in any case is limited to the fees paid for the specific service giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or business opportunities, arising from use of our services.
10Prohibited Activities
Users must not use our platform for any unlawful purpose, attempt to gain unauthorized access to our systems, submit fraudulent documents, impersonate any person or entity, or engage in any activity that disrupts or interferes with our services or other users.
11Dispute Resolution
In case of any dispute, both parties shall first attempt to resolve it through good faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act 1996. The seat of arbitration shall be New Delhi, India.
12Governing Law
These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes not resolved by arbitration shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
